Please read these Terms of Service ("Terms") carefully before using the website ardeluz.com (the "Site") or purchasing any products from Ardeluz. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site.

1. General

These Terms govern your access to and use of the Site, as well as all products, content, and services available through the Site. The Site is operated by Ardeluz, a business headquartered in Montreal, Quebec, Canada.

We reserve the right to update or modify these Terms at any time without prior notice. The most current version will always be available on this page with the "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

By using this Site and placing an order, you represent that you are at least the age of majority in your province or territory of residence. If you are under the age of majority, you may use the Site only with the involvement and consent of a parent or legal guardian.

You may not use our Site for any illegal or unauthorized purpose. You agree to comply with all applicable laws and regulations in connection with your use of the Site.

3. Online Store Terms

By agreeing to these Terms, you represent that you are at least the age of majority in your province or territory of residence and have given us your consent to allow any of your minor dependents to use this Site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Site, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any malicious code, worms, or viruses, or any code of a destructive nature.

A breach or violation of any of these Terms will result in immediate termination of your access to the Site and our services.

4. Products and Services

4.1 Product Descriptions

We make every effort to display and describe our products as accurately as possible. However, because Ardeluz candles are handcrafted in small batches, slight variations in colour, texture, wax appearance, and vessel finish may occur between batches. These natural variations are inherent to the artisan production process and are not considered defects.

Photographs on the Site are for illustrative purposes. While we strive for accuracy, we cannot guarantee that your device's display of any colour or detail will be perfectly accurate.

4.2 Product Availability

All products are subject to availability. We reserve the right to discontinue any product at any time without notice. We reserve the right to limit the quantity of any product or service that we offer. We are not obligated to fulfil any order if a product becomes unavailable after you place your order.

4.3 Personal Use Only

Products purchased from Ardeluz are for personal, non-commercial use only. You may not resell, commercially distribute, or exploit our products without our prior written consent. This does not restrict your ability to give our products as gifts.

5. Pricing and Payment

5.1 Pricing

All prices on the Site are displayed in Canadian Dollars (CAD). Prices do not include applicable taxes (GST, QST, HST, or PST), which will be calculated and displayed at checkout based on your shipping address and applicable provincial and federal tax rates.

We reserve the right to change prices at any time without notice. Prices in effect at the time you place your order will apply to that order.

5.2 Pricing Errors

In the event of a pricing error on our Site, we reserve the right to cancel any orders placed at the incorrect price. If your order is cancelled due to a pricing error, we will notify you by email and issue a full refund to your original payment method. If you have already been charged, the refund will be processed within 10 business days.

5.3 Payment

We accept the following payment methods through Shopify Payments: Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, and Shop Pay. Additional payment methods may be available at checkout.

All payments are processed securely by Shopify Payments (powered by Stripe), a PCI-DSS Level 1 compliant payment processor. We do not receive, access, or store your full credit card number.

Payment must be received in full before an order is shipped. By providing your payment information, you represent that you are authorized to use the payment method and authorize us to charge the total order amount (including taxes and shipping) to that payment method.

6. Orders

6.1 Order Acceptance

Placing an order on the Site constitutes an offer to purchase. All orders are subject to acceptance by Ardeluz. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Product unavailability
  • Pricing errors
  • Suspected fraud or unauthorized transactions
  • Incomplete or inaccurate order information
  • Orders that exceed reasonable quantity limits

If we cancel your order after payment has been taken, we will issue a full refund to your original payment method.

6.2 Order Confirmation

An order confirmation email is sent to you after you place your order. This email acknowledges receipt of your order but does not constitute acceptance. Your order is accepted and a binding contract is formed only when we ship your order and send you a shipping confirmation email.

6.3 Order Modifications and Cancellations

If you need to modify or cancel your order, please contact us at service@ardeluz.com as soon as possible. We will make reasonable efforts to accommodate your request, but we cannot guarantee modifications or cancellations once an order has entered processing. Orders that have already shipped cannot be cancelled and must be returned in accordance with our Return and Refund Policy.

7. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms by reference. Please review our Shipping Policy for details on processing times, shipping methods, delivery estimates, and related matters.

Risk of loss and title for items purchased from the Site pass to you upon delivery of the items to the shipping address you provided at checkout. We are not responsible for delays caused by the shipping carrier or for packages delivered to an incorrect address that you provided.

8. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference. Please review our Return and Refund Policy for details on return eligibility, timelines, and refund procedures.

Nothing in our Return and Refund Policy is intended to limit or exclude your statutory rights as a consumer under applicable provincial or federal consumer protection legislation.

9. Candle Safety and Assumption of Risk

Ardeluz candles involve the use of an open flame. By purchasing and using our products, you acknowledge the inherent risks associated with burning candles and agree to follow all safety instructions provided with your purchase and on our Candle Care page.

Safety instructions are included with every candle and are available on our Site. It is your responsibility to read, understand, and follow these instructions before lighting your candle.

Ardeluz shall not be liable for any damage, injury, or loss resulting from misuse of our products, negligence, or failure to follow the safety instructions provided. This limitation does not apply to injuries or damages caused by a defect in the product.

10. Intellectual Property

10.1 Ownership

All content on the Site — including but not limited to the brand name "Ardeluz," logos, product names, scent names, product descriptions, product photography, illustrations, website design, text, graphics, icons, and software — is the property of Ardeluz or its content suppliers and is protected by Canadian and international intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include:

  • Any resale or commercial use of the Site or its content
  • Any collection, harvesting, or use of product listings, descriptions, photographs, or prices
  • Any derivative use of the Site or its content
  • Any downloading, copying, or reproduction of account information for the benefit of another party
  • Any use of data mining, robots, scrapers, or similar data-gathering or extraction tools

This license may be revoked by us at any time without notice or liability.

10.3 Trademarks

"Ardeluz," the Ardeluz logo, and all product and collection names are trademarks of Ardeluz. You may not use our trademarks without our prior written consent.

11. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Update your account information promptly if it changes
  • Notify us immediately at service@ardeluz.com if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.

12. Prohibited Uses

In addition to any other prohibitions set forth in these Terms, you are prohibited from using the Site or its content:

  • To violate any international, federal, provincial, or local regulations, rules, or laws

  • To submit false or misleading information
  • To upload or transmit viruses, malware, or any other type of malicious code
  • To collect or track the personal information of others without their consent
  • To interfere with or circumvent the security features of the Site
  • To spam, phish, or scrape content from the Site
  • For any obscene or immoral purpose

We reserve the right to terminate your use of the Site for violating any of these prohibited uses.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARDELUZ, ITS OWNERS, EMPLOYEES, DIRECTORS, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PURCHASE OF OUR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR PURCHASE OF OUR PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO ARDELUZ FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

SOME PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IN SUCH PROVINCES, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Quebec Consumers: Nothing in these Terms is intended to exclude or limit any rights you may have under the Consumer Protection Act (Quebec), including implied warranties of fitness, durability, and safety, which cannot be excluded or waived by agreement.

14. Indemnification

You agree to indemnify, defend, and hold harmless Ardeluz, its owners, employees, directors, agents, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of the Site or violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Your violation of any applicable law or regulation
  • Any misrepresentation made by you

This indemnification obligation will survive the termination of these Terms and your use of the Site.

15. Force Majeure

Ardeluz shall not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemic or epidemic, war or acts of terrorism, government actions or restrictions, postal or carrier strikes, labour disputes, supplier disruptions, internet or telecommunications failures, power outages, or severe weather events.

In the event of a force majeure event, we will make reasonable efforts to notify you and to resume performance as soon as practicable.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of the judicial district of Montreal, Quebec.

Nothing in these Terms shall be interpreted as excluding, restricting, or modifying the application of any provision of the Consumer Protection Act (Quebec) or any other mandatory consumer protection legislation that cannot be excluded by agreement.

17. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, and Shipping Policy, constitute the entire agreement between you and Ardeluz regarding your use of the Site and purchase of our products, superseding any prior agreements or communications.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms of Service are available in both English and French. In the event of any discrepancy between the two versions, the French version shall prevail, in accordance with the Charter of the French Language (Quebec).
